These Terms and Conditions ("Terms") govern your use of DubaPays payment processing services ("Services") provided by DubaPays ("we," "us," or "our"), operating from Unit No: BA2337, DMCC Business Centre, Level No 1, Jewellery & Gemplex 3, Dubai, United Arab Emirates.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
3.1. You must be at least 18 years of age to use our Services.
3.2. Business users must be legally registered entities with valid business licenses.
3.3. You must provide accurate, current, and complete information during registration.
3.4. You represent that you have the legal authority to bind the entity you represent.
4.1. To use our Services, you must create an Account by providing required information including email, name, company details, and contact information.
4.2. You are responsible for maintaining the confidentiality of your Account credentials.

6.4. All payments are processed through our authorized payment partners including Stripe, Visa, Mastercard, American Express, and other integrated payment systems.
6.5. Transaction limits and processing times may vary based on payment method and verification status.
7.1. Service fees will be communicated to you during the onboarding process and may vary based on transaction volume, payment methods, and services utilized.

10.1. Refund policies are determined by Merchants for their transactions.
10.2. Chargebacks initiated by Customers will be investigated according to card network rules.
10.3. Merchants are responsible for responding to chargeback requests and may be liable for chargeback fees.
10.4. Excessive chargebacks may result in Account suspension or termination.
11.1. We implement industry-standard security measures to protect your data.
11.2. All payment data is encrypted and processed in compliance with PCI DSS standards.
11.3. You are responsible for maintaining the security of your Account access credentials.
12.1. All content, trademarks, logos, and intellectual property on our platform remain our exclusive property.
12.2. You are granted a limited, non-exclusive license to use our Services for their intended purpose.
12.3. You may not copy, modify, distribute, or create derivative works without our written consent.
13.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUBAPAYS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
13.2. Our total liability for any claims arising from these Terms or the Services shall not exceed the fees paid by you in the 12 months preceding the claim.

16.2. If negotiation fails, disputes shall be resolved through arbitration in Dubai, UAE, in accordance with the DIAC Arbitration Rules.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Dubai International Financial Centre (DIFC) where applicable.
18.1. We comply with UAE AML/CFT regulations and international standards.
18.2. We reserve the right to request identification and business documentation for verification and additional documentation at any time.
18.3. Suspicious transactions will be reported to relevant authorities.
We reserve the right to modify these Terms at any time. Material changes will be notified via platform notification at least 30 days before taking effect. Continued use of Services after changes constitutes acceptance.
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, regulatory changes, or technical failures.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms constitute the entire agreement between you and DubaPays regarding the Services and supersede all prior agreements and understandings.
